Customer Obligations

You agree not to do any of the following while using the Hook & Ladder Winery Site:

  • Intentionally or unintentionally violate any applicable law or regulation.
  • Access, tamper with, or use nonpublic areas of the www.hookandladderwinery.com or our computer systems. Unauthorized individuals attempting to access or tamper with these areas may be subject to prosecution.

The Sale of Alcoholic Beverages

Hook & Ladder Winery does not sell alcohol to persons under the age of 21. By using this site you swear and affirm that you are over the age of 21. Hook & Ladder Winery makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 21. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from Hook & Ladder Winery is over the age of 21. You also agree that any alcohol purchased from Hook & Ladder Winery is intended for personal consumption and not for resale. If you do not agree with these conditions of use please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, Hook & Ladder Winery will prosecute you fully to the extent allowable by law.

Shipping of Hook & Ladder Winery

Hook & Ladder Winery ships only to states where alcohol can be shipped. The following states cannot ship by law: Alabama, Arkansas, Delaware, Kentucky, Massachusetts, Mississippi, Oklahoma, Pennsylvania, South Dakota, or Utah.

Hook & Ladder Winery reserves the right to hold shipment of your wine during extreme weather conditions.

Although unlikely, we reserve the right to raise prices for shipping/handling without notice.

Hook & Ladder Winery cannot be responsible for damage to wine (including leakage or damaged corks) shipped to you against our express protestations in regards to weather conditions.

Hook & Ladder Winery cannot be responsible for wine damaged by a shipper or inappropriate storage/handling on the part of the buyer, although we will make a reasonable effort to resolve any disputes.

We reserve the right to refuse sales if we deem it to be inappropriate and/or unsafe.

Return Policy

If you’re not happy with a purchase or one of our recommendations, we’ll do what we can make you happy. We ask our customers to acknowledge that wine is a living thing, easily bruised, damaged, or destroyed in a variety of ways. All wine sold by us is maintained at optimum conditions. We consider wine to be out of our control once it has been successfully delivered and you’ve had a reasonable amount of time to sample it. We cannot be responsible for improper storage (storing on top of your refrigerator, in your car, next to your oven, for example). Know your palate: Older wines (ten years or more) may differ from their characteristics on release – and still be great wines. If you purchase older wines, be patient and allow your mind – and the wine – to open. We cannot accept returns for sound wines that do not coincide with personal tastes. In general, Hook & Ladder Winery will make every effort to resolve any wine issues to your satisfaction.

Title and Ownership

Title to, and ownership of, all wine passes from Hook & Ladder Winery to the purchaser at the warehouse and state it is purchased in and the purchaser takes all responsibility for the shipping it from the warehouse to his/her home state. By arranging for transportation of the wine, Hook & Ladder Winery is providing a service to, and acting on behalf of the purchaser. By utilizing this service from Hook & Ladder Winery, the purchaser is representing that he/she is acting in a fashion compliant with his/her local and state laws regarding the purchase, transportation and delivery of wine. The purchaser represents that he/she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine and is legally entitled to take quantities ordered and once again authorizes that he/she is 21 years of age.

Hook & Ladder Winery reserves the right to close customer accounts and request alternative forms of payment if a fraudulently obtained voucher is redeemed through the Hook & Ladder Winery Web site or is redeemed on the Hook & Ladder Winery Web site.

Hook & Ladder Winery, AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO VOUCHERS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A VOUCHER CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH VOUCHER. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

Hook & Ladder Winery reserves the right to change these terms and conditions from time to time in its discretion.
